Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your use of services provided by CW Web Design ("we," "us," or "our"). By purchasing a package or engaging our services, you agree to be bound by these Terms.
2. Services
We provide custom website design, development, and ongoing maintenance services for small service-based businesses. Specific deliverables, timelines, and pricing are outlined in your selected package or written agreement.
3. Client Responsibilities
- Provide accurate information, content, and materials in a timely manner
- Respond to communications and review requests within a reasonable time
- Ensure you own or have rights to all content (text, images, logos) you supply
- Pay all invoices according to the agreed schedule
Project timelines may be extended if delays are caused by missing content or delayed responses.
4. Payment
Project fees are due as stated in your package or invoice. We accept Visa, MasterCard, American Express, Zelle, and Apple Pay. Payment plans may be available upon request. Late or unpaid balances may pause work or delay launch.
5. Maintenance
Every website purchase includes 3 months of site maintenance with up to 5 changes per month. After the initial 3 months, ongoing maintenance is available for $50/month with up to 10 changes monthly. Unused changes do not roll over.
6. Revisions & Scope
Each package includes a defined scope of work and a reasonable number of revisions. Significant additions outside the agreed scope may require additional fees, communicated in writing before work begins.
7. Ownership
Upon full payment, you own the final website design and content provided by you. We retain the right to display the completed project in our portfolio and marketing materials unless you request otherwise in writing.
8. Third-Party Services
Your website may rely on third-party services (hosting, domains, plugins, analytics, etc.). We are not responsible for outages, changes, or fees charged by those providers.
9. Limitation of Liability
To the maximum extent permitted by law, CW Web Design is not liable for indirect, incidental, or consequential damages, including lost profits or data. Our total liability for any claim is limited to the amount paid by you for the services in question.
10. Termination
Either party may terminate a project for material breach of these Terms. If you cancel after work has begun, fees for completed work are non-refundable (see our Refund Policy).
11. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes will be resolved in the appropriate courts of San Joaquin County, California.
